Please read these Terms of Service ("Terms") carefully before using the Attendance Genius website and application (the "Service") operated by Attendance Genius ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, or by checking the "I Agree" box at registration, you agree to be bound by these Terms.

1. User Accounts

Account Creation

You must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms.

Account Security

You are responsible for safeguarding the password that you use to access the Service. We enforce strict password complexity requirements: passwords must be at least 12 characters long and include a mix of uppercase letters, lowercase letters, numbers, and symbols. We are not liable for any loss or damage arising from your failure to comply with the above.

We support Two-Factor Authentication (2FA) for all user accounts. To ensure the security of Student Data, we require and enforce 2FA for all administrator and staff accounts upon login.

Account Responsibility

You are responsible for all activity that occurs on your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. User-Generated Content

If our Service allows you to post, link, store, share, and otherwise make available certain information ("User Content"), you are responsible for that User Content.

Ownership

You retain any and all of your rights to any User Content you submit. Specifically, all Student Data and Education Records provided to the Service remain the sole property and under the control of the Educational Institution. We claim no ownership over your User Content or Student Data.

License Grant

By creating User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, store, reproduce, and display such content solely for the purpose of operating and providing the Service to you. We will not use your User Content for any other purpose.

3. Acceptable Use Policy

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. You agree not to:

• Attempt to gain unauthorized access to, or disable any part of, our servers, networks, or systems.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Upload any content that infringes on any intellectual property right or is unlawful, harmful, or fraudulent.
• Use the Service to transmit spam or other unsolicited commercial messages.
• Attempt to probe, scan, or test the vulnerability of our systems.

4. Fees and Payment

Billing

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring basis.

Free Trial

We may offer a free trial for a limited period. We reserve the right to modify or cancel the free trial at any time.

Refunds

All fees are non-refundable except as required by law.

5. Termination

Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Termination by You

You may terminate your account at any time by using the "Delete Account" feature in your account settings or by contacting us.

Effect of Termination

Upon termination, your right to use the Service will immediately cease, and we will initiate the permanent deletion of your data in accordance with our Privacy Policy.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Attendance Genius and its licensors.

7. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. The Service is provided without warranties of any kind, whether express or implied.

8. Limitation of Liability

In no event shall Attendance Genius, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

10. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
